Our Death Penalty Debate written by Mark

 Hello, how are you doing? I hope you are in the BEST of health & spirits as you enjoy your day…. and that you find something here that enriches your life with knowledge, in some way in the debate over Capital Punishment. The ultimate punishment we have in the United States. The most civilized country in the world! Because no matter WHICH WAY you look at the Death Penalty, OR what your personal opinion is, whether for or against Capital Punishment. There is indeed a GREAT deal to be learned & talked about regarding it. Many interesting & controversial conversations & debates can come from it, whether it is religion, moral or humane, political, right or wrong, evil or good, justice or pure retaliatory vengeance. There IS a never ending debate about the Death Penalty & ALL that surrounds it. How many other topics are so controversial?? Capital Punishment IS such a POWERFUL & deadly topic it should NOT be taken lightly. It is just sad that in this day & age in one of the SO-CALLED most civilized Nations in the World like the United States of America we are still executing our own citizens & not even trying to correct the problem at hand OR help rehabilitate those who need it within the prison system.

 

When I was first arrested in 1993 I did not even know that the Death Penalty existed in America. I heard it said time & time again that the Death Penalty is a “DETERRENT TO CRIME”, yet there is no true rationale to that. If you really sit back & think about it, do you think the would-be offender sits back & contemplates what the sentence will be if he/she is caught?? NO, the would-be offender ONLY thinks he/she can beat the police & get away with whatever him/herself outweighs the benefits. Since most murders occur during a robbery or a heated situation, a person is not going to take a moment to evaluate the consequences of his/her actions. Actions happen before consequences can be considered. So, ask yourself how can the Death Penalty be a deterrent to crime, if a criminal NEVER thinks about the sentence if he/she is caught? Isn’t a DETERRENT to crime a BIG yellow or red flag that say’s to someone “OH NO; IF I DO THIS I COULD BE SENTENCED TO _____ & I should not do that?” A TRUE deterrent would be SOMETHING that catches a persons thought BEFORE he/she ever commits a crime & reminds that would-be offender to stop what they are about to do.

Most Citizens do NOT even KNOW the sentence for crimes in their state, I mean ask yourself… “Do you know what you would be charged with or sentenced to, for stealing a 60 c candy bar, or a $500 gold ring, or a $28,000 car? Or do you know what you would be sentenced to for assaulting someone?? Better yet, let’s take a more naïve crime like disposing of some trash (like and old couch or TV) behind a grocery store; do you know what the penalty is for that??” The answer is most likely “NO you do not know those simple facts”. So how do politicians expect you to believe the Death Penalty is a deterrent to crime?? OR that another sentence is a deterrent to crime for that matter, if a person doesn’t even know what he/she could be sentenced to & most likely doesn’t even consider or contemplate the penalty for any given crime, when they are in the act of carrying it out??

Research has not been able to find any support for the argument that the level of use of “Capital Punishment (Death Penalty)” influences the murder rate in the United States. When homicide rates were compared for abolitionist versus retentionist jurisdiction, or before & after a change in Capital Punishment policy or before & after highly publicized executions, NO PROOF was found that was able to correlate homicide rates with executions. Therefore, it could NOT be proven that the Death Penalty serves as a deterrent. While there has not been much evidence to suggest the Death Penalty serves as a deterrent, there has been more solid evidence to suggest it does not.

Another aspect of the Death Penalty has to do with whether or not the sentence prevents murderers form committing further crimes. The belief that convicted murderers are a threat to society IF released is not inevitably true. In fact 243 death row prisoners who had their sentences commuted as a result of FURMAN have been released. From those stated prisoners released, only one killed again. Surely if all the FURMAN prisoners were executed it would have prevented this one additional killing. However, the fact of the matter is that most convicted murderers DO NOT kill again. I have found data that shows 0.3 percent of offenders – (three in a thousand) - released after conviction for murder were later represent a disproportionate threat to society. Therefore a sentence of Life Without the possibility of parole WOULD prevent murderers from being able to commit further crimes, as opposed to the Death Penalty.

The majority of society misinterprets the sentence of “Life without Parole”. Many think that if a convicted murderer is sentenced to Life Without Parole, that somehow he/she will eventually be able to get paroled, as was a slight possibility many decades ago. However, laws have since been rewritten and the sentence of “Life Without Parole” NOW LITERALLY means that anyone convicted & sentenced to “Life Without Parole”, WILL remain in prison until the day he/she dies. There won’t even be a remote possibility someone sentenced to Life Without Parole would ever set foot in a Parole Board Hearing. With this in mind, there are studies that show that when people are given this factual info, support for the Death Penalty drops & they pick “Life Without Parole” as a sentence for convicted murderers. A Gallup Poll showed support for the Death Penalty on a steady decline, even more so now that the sentence of “Life Without Parole” literally means a convicted murderer will die in prison & NEVER have any chance at release/parole.

The cost of carrying out an execution is difficult to estimate, due to each Condemned prisoners case facts & appeals being different. It is known that the cost of housing a prisoner per year is $33,581, but this is the cost of a prisoners housing with a Life Without Parole & OR lesser sentence. However, those prisoners sentenced to the Death Penalty have an ENORMOUSLY higher cost. This is due to the fact that “Capital Cases’ (cases/trials in which the Death Penalty is sought by Prosecution)” are often lengthy trials which Legal Defence & Expert Witnesses must be used for. These fees’s for such legal defences in Capital Cases are often very costly due to the “High Publicity” factor involved. The real cost mandated by the Legislature as well as the appeal procedures initiated by the convicted prisoners legal staff, procedures in which every U.S. citizen is constitutionally afforded. These costs vary depending on the resources of the convicted Condemned prisoner. Factual estimates show it is less costly to house a convicted murderer who is sentenced to Life Without Parole for the rest of his/her life, rather than somebody sentenced to Death.

Capital Punishment has been around since LONG BEFORE 560 BC; even Jesus Christ was executed. Capital Punishment has been used in just about every form imaginable: everything from beheading, burning at the stake, hanging, lynching, firing squad, electric chair, gas chamber, & the more current lethal injection. There have even been different forms of torture in the 18th century. However, Capital Punishment (The Death Penalty) has NEVER solved any problem society has faced. Hundred of thousands have been executed by kings & or government, yet year after year, decade after decade we are in the exact same boat. Why is this?? The ONLY solid conclusion any rational thinking human being can come up with would be that Capital Punishment just does not work to solve any problem. If Capital Punishment does not solve society’s problems, then what exactly is it used for?? Is it a sick twisted gift of RETRIBUTION/VENGEANCE for the victim’s families & friends, a “Political Tool” politicians use for grandstanding to bid for elections, or is it just the cash cow used to justify the milking of tax dollars spent, OR ALL OF THE ABOVE?? OBVIOUSLY Capital Punishment IS SURELY NOT used to solve any of society’s problems/troubles & is a disgraceful failure!

One HARD FACT is that Capital Punishment is NOTHING MORE than a “political grandstanding tool” that politicians USE to their advantage to get elected & or not being safe in their communities or homes?? Politician’s BANK on the fact that society does not like the notion of being unsafe in their communities & or homes and they DRILL this fact home to get society to the polls voting on & or supporting bills that create more new laws politicians can USE to manipulate society into believing in a certain way about issues such as crime & Capital Punishment. There has been survey after survey done & the “MEDIA” always quotes a certain percentage of society “is for or against” Capital Punishment. Have you ever wondered HOW those percentages are reached OR WHY people are for or against Capital Punishment? Well, from my studies those statistics/percentages are come to by “TRICK QUESTIONS”.

For example, when the Media conducts a survey they ask “False Blind Questions”. What I mean is, the questions being asked in the surveys are questions that are ASSUMED to be true questions, but that are based on non-factual issues (false facts), such as Capital Punishment being a so-called deterrent to crime. The media survey agency will ask a question such as: “If the Death Penalty was a deterrent to crime would you be for it or against it”?? Well, people answering the survey saying people are for the death penalty. HOWEVER, the media FAILS TOTALLY to inform you that the survey was based on a question/fact that does NOT exist because the Death Penalty is NOT a deterrent. The people answering the survey were not informed that the Death penalty is not a deterrent. They answered the survey under the assumption that the surveyor was asking a question based on TRUE FACTS, not false blind facts. So the media surveying agency just got people to bolster a statistical number that was based on non-factual questions. Then this HIGH statistical percentage is published in news-papers, magazines & on the TV News. And when society learns of this high percentage of people who are supposedly for Capital Punishment, they follow the lead & are for it also, when it was falsely based on trick questions by the media survey agency all along.

Politicians, District Attorney’s, &  Police/Sheriff’s LOVE the fact that false statistics/percentages are being published, because that allows them to CONTINUE their manipulation of society, once again BANKING on society’s fear of crime. Politicians continue to go on saying “OH YEAH, I’m TOUGH ON CRIME“. That in turn gets politicians votes to be elected into some office or HIGHER position to further his/her career. I mean come on; do you really think a politician would come out & admit “I don’t believe in Capital Punishment”?? No WAY that would be political suicide & that a politician would not have a “subject” to promote himself/herself to get votes. In fact there are MANY political figures & officials in police agencies who truly do not believe in Capital Punishment, but refuse to acknowledge this publicly because of the implications that he or she would be “soft on crime”. When in reality it isn’t about being soft on crime, but rather it IS about being against a broken Capital Punishment system that does not work for what it’s intended. Another reason Political Figures & Police Agencies would not admit they are against Capital Punishment is because IF they would do so they would be losing a tool ( society’s fear of not being safe in their communities) to justify higher taxes & or the use of tax dollars to hire more police, build more prisons, & create more new laws to control society. Plus, it is no secret that Congress approves the spending of funds to be spent on a new prison, BUT the money is never spent on the new prison & the funds are diverted to other things, like governments frivolous spending of tax payer’s dollars. Telling society, tax dollars are being spent one way but secretly using the funds to do other things. Big Brother is not stupid by any means, & knows EXACTLY what is going on. The simple fact is that Capital Punishment & the “tough on Crime” stance is a POLITICIAN’S “MULTI PURPOSE TOOL” to justify all sorts of things.

There is also the aspect of people involved who are pro-tough on crime & or pro-capital punishment that always seem to suggest that criminals are “monsters” & such. Like criminals are born genetically with a mind set to do bad things. This notion is laughable, I mean if people are born genetically to do bad things, why aren’t people born genetically to do other specific things such as being a; a fairy, a magician, fireman, lawyer, president, race car driver, or doctor. It just does not work like that; humans are born as just that, a human being. The simple fact is that human beings are raised differently from family to family community to community & the things we humans endure and learn growing up, shape who we are and what we become. Some have a loving affectionate family, other families are not so loving and do not communicate and then there are families who are broken and abusive in one way or another. A person from a loving family can do bad things and a person from a broken family can do good things. Life is all about circumstances and our individual resources and things we learn in life. A good person can get in a bad situation and have no support and the lack of support can lead to this good person snapping and doing something terribly wrong. A person from a broken family can get in a bad situation and have a good support group that helps him/her out of hard times. There are numerous factors in life that cause people to go through life in different ways. Despite what some suggest, no one is truly born evil or bad. However, Police agencies, District Attorneys and Politicians go with the flow that criminals are so called “monsters” and even make statements to that effect, because they would like people in society to believe there are just purely evil people out there in the world that STRIVE to commit criminal acts so Police Agencies, District Attorneys and Politicians can once again play on societies fears of not having safe communities. When in fact this propaganda machine that keeps on running is only an illusion masking other more important factors that continue to lead our society down the wrong path. While society is fed up with crime and focus their frustration at criminals, Politicians love this because it takes the focus off of them and the FACT that the “economy” and “Educational” failures are what is truly to blame for crime. It is NO SECRET that during bad economic time’s crime increases, as well as those who live in poverty stricken communities and have difficulty gaining employment. The same can be said for Education, those who have poor educational skills have a hard time gaining employment. Thus crime is resorted to for survival. Those people who are "Pro Tough On Crime", as well as Police agencies, Prosecutors & Politician's ignore this fact because it puts the blame directly in their lap for not running our communities better. Many continue to blame so called criminals, but the picture IS much bigger and the blame game is only that, a game. Until society hold Politician's accountable for Economical and Educational shortfalls, we will continue to have crime problems. Instead of creating more laws to lock people up in prison and or build new jails and prisons, we NEED to be putting more funding into Education and community resource centers for our youth to have activities to occupy their minds and time. Shifting the blame to criminals is only a self serving tool that helps no one.Not only that, but HOW can a Nation like the United States. Tell other foreign countries it is "in-human" and wrong to use the Death Penalty, yet the United States of America itself continues to use the Death Penalty?? How can America be a LEADER if it continues to do things it tells other countries they are wrong for doing?? If you ask me I'd say America is a HYPOCRITE & IS LACKING IN WORTHINESS TO BE TRUSTED TO LEAD. Isn't there a saying "LEAD BY EXAMPLE"? Then WHAT KIND of example does America expect to set? What kind of "Big Brother" is the United States of America?? Let me tell you… I used to be PROUD to be an American and trusted it DID do the PROPER THING. However when I went through my arrest, trial and conviction I questioned my pride in my country. I came to learn that I am part of "THE SKELETONS IN AMERICA'S CLOSET". America holds its head high in its belief it is RIGHTEOUS AND JUST. But I've learned America, just as EVERYONE in the world, COULD go A LONG WAY with a bit of "Humble PIE" (humbleness), because "SELF RIGHTEOUSNESS" can only get you so far in life. Don't get me wrong, I am NOT bashing America or saying it does not do GOOD THINGS in the world, because it does. However, I am saying there are things going on in the world, that we as citizens of the world NEED to open our eyes to and NOT ALLOW politicians to get away with it. We need to make our voices heard, and we NEED to think outside the box, to see what EXACTLY is going on in our world. We can not sit back in the comfort of our living rooms and expect things will get done properly. Getting out and voting is a good way to make your voice and opinions count. It does not even matter if you are living in America; you can live in England, Ireland, the Netherlands, Sweden, Australia, Germany, France or ANY other foreign country for that matter, and still make a difference. You can write to your politicians and express your beliefs and ask them to put pressure on America to stop the Death Penalty. There ARE things your country can do to "put America in Check". I mean come on, WHY is America ALWAYS "policing" other countries when it can't even properly take care of its own "dirty laundry"?? You can help police America, your politicians can enact strict trade agreements and other such things to tighten the grip on America's HYPOCRISY and get America to LEAD BY EXAMPLE and abolish the Death Penalty, as it tells Foreign countries to do. This is a battle WE MUST ALL FIGHT!

Capital Punishment was widely applied in ancient times throughout the world. The modern movement for the abolition of Capital Punishment began in the 18th century with the writings of Montesquieu and Voltaire. Some of the first countries to abolish Capital Punishment include Venezuela (1863), San Marino (1865) and Costa Rica (1877). In Great Britain, Capital Punishment was abolished in 1971, except for cases of treason. Canada in 1976 France abolished in 1981, and since 2000 Chile, Yugoslavia, Serbia, Montenegro have also joined the growing list of abolitionist countries. Today, over half the countries in the world have abolished the Death Penalty either by law or practice. Executions only take place in a handful of countries like: China, Iran, Saudi Arabia and the United States. In 1977, the United Nations General Assembly affirmed in a formal resolution that throughout the world, it is desirable to "progressively restrict the number of offences for which the Death Penalty might be used, with the view to the desirability of abolishing this punishment all together". 

Through this web page I HOPE to inspire truth and dispel some of the MYTHS; STEREO TYPES and political propaganda about the Death Penalty. Throughout this web page there will be FACTS about the Death Penalty and I will in certain sections use my own case as an example of how the Death Penalty is unjustly administered. So please, enjoy and know I don't mind if you are against me. I am not saying criminals do not need to be punished in some way, but we as humans need to help our neighbour (fellow citizen) so we can continue the good faith and strengthening of our society so people do not fall and end up in bad situations like I am in. 'Because it TRULY can happen to any one of us'. You don't necessarily need to be a career criminal. I am surely NOT, and I ended up on death row. This is my FIRST TIME in prison; I had NEVER before been so much as convicted of fighting someone. ANYONE can be a "VICTIM OF CIRCUMSTANCES IN LIFE".

A stressful year at the office, compiled with a stressful relationship, or bankruptcy, and the loss of a loved one, and or some depression… ANYTHING, ANY COMBINATION of events in life can lead to someone "snapping" and doing something out of character. It does NOT mean you are a bad person or are EVIL... we ALL are human & have made mistakes in life, whether we want to admit to them or not. It's just some of us have friends, family or some sort of stress reliever, or are somehow able to cope with things in life a bit easier than others. But there are some who don't have such support to help us through those times, or our friends and family never saw we needed the helping hand so they did not reach out to us. Just because someone commits a criminal act does not mean they are evil or bad. One second, or one minute, or one hour, or one day in someone’s life DOES NOT DEFINE WHO THAT PERSON IS. Just because you stole a candy bar as a kid, does not mean you are a thief all your life; just because you had an argument with someone in life does not mean you go around fighting and arguing with everyone. We as humans are defined by a compilation of acts in and throughout our life, NOT by one minute or one act in our life.
